EMAIL OPTION AND SUBMISSION ON THIS PAGE FORENCORE USA LLC WILL BE REQUIRED TO BE ENTERED INTO THE GIVEAWAY TO RECEIVE THE PRIZE PACKAGE. EACH OPT-IN AND FORM SUBMISSION WILL GRANT ONE (1) ENTRY TO BE DRAWN ON THE GIVEAWAY ANNOUNCEMENT DATES IN NOVEMBER OF2021. TO RECEIVE THE GIVEAWAY PRIZE PACKAGE, RECIPIENTS MUST BE IN A LEGAL STATE OR REGION AND ARE RESPONSIBLE FOR ALL POTENTIAL TAX LIABILITIES. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

By entering you agree to these Official Rules and the decisions of Encore USA LLC or its designee, which are final and binding in all respects.

ENTRY PERIOD: The start date for the giveaway period is November 15th, 2021 at 12:00am PST, and the end date for the giveaway is November 25th, 2021 at 11:59pm PST. The cutoff time for each weekly entry period for the giveaway prizes is:

November 19th at 11:59pm PST for Prize Bundle #1
November 22nd at 11:59pm PST for Prize Bundle #2
November 25th at 11:59pm PST for Prize Bundle #3

ELIGIBILITY: The giveaway is offered only in authorized areas of the United States to legal residents of the 50 United States who are at least 21 years old at time of entry (does not include Alaska or Hawaii). Void where prohibited by law. The giveaway is not open to giveaway organizers, employees and directors of Encore USA LLC. When listed, some giveaways are only open to retailers and/or affiliates within the U.S.

PRODUCT: Product values will vary for each giveaway. Winners may receive products including Encore USA LLC products, apparel and/or Encore USA LLC gift cards or discounts.

ODDS OF RECEIVING: Odds of receiving are based on the number of entries during the giveaway Period. We use a random selector to choose giveaway recipients, and post the result directly on our website and social channels, along with emailing the giveaway recipient directly to coordinate claiming their product.

RECIPIENT NOTIFICATION AND ACCEPTANCE: The recipient will be notified via email used to opt in to the giveaway on EncoreUSA.Store. The recipient will receive the product at the address they provide after notification and acceptance.

Inability to reach the recipient by email after reasonable efforts (as determined solely by giveaway organizers) may result in disqualification and an alternate recipient may be selected. Recipients may waive their right to receive a Product. Product is non assignable and non transferable. Substitutions will be available only at the discretion of the giveaway organizers. The giveaway organizers are solely responsible for providing the Product directly to specified recipients. Recipient is solely responsible for reporting and payment of any taxes. Except where prohibited, participation in a giveaway constitutes an entrant's consent to the publication of his or her name in any media for any commercial or promotional purpose, without limitation or further compensation.

PARTICIPATION: Participation in the giveaway constitutes an agreement by each entrant to comply with these Official Giveaway Rules. In the event the Giveaway is compromised by causes beyond the reasonable control of Encore USA LLC which corrupt or impair the administration, security, fairness or proper operation of the giveaway, Encore USA LLC reserves the right in its sole discretion to suspend, modify or terminate the giveaway. Should the giveaway be terminated prior to the stated expiration date, Encore USA LLC reserves the right to award the Product based on the entries received before the termination date.

LIMITATIONS OF LIABILITY: By entering the giveaway, entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with the giveaway, or any Product awarded, shall be resolved individually without resort to any form of class action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the giveaway, but in no event attorney’s fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.

Giveaway organizers are not responsible for any incorrect or inaccurate information, whether caused by web site users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the giveaway and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the web site. Giveaway organizers are not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this giveaway or downloading materials from or use of the web site. CONSTRUCTION: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Giveaway Rules, or the rights and obligations of any entrant and Encore USA LLC, shall be governed by, and construed in accordance with the laws of the state of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of Utah, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Utah. The invalidity or unenforceability of any provision of these rules shall not affect the invalidity or unenforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

GENERAL RELEASE: By entering the giveaway, entrants release Encore USA LLC, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the giveaway or with the acceptance, possession or use of any Product (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).
